Terms and Conditions

§1 [GENERAL PROVISIONS]

 

  1. This document sets out the terms and conditions for using the Immo Lab service.
  2. The owner of the service is Immo Lab sp. z o.o., ul. Mińska 29a, 03-808 Warsaw, NIP: 113-304-98-91.
  3. Using the online service implies acceptance of the Terms and Conditions and the Privacy Policy.
  4. The terms used in the regulations mean:
    1. Platform - an online platform operated by the Service Provider in Polish at https://immolab.re,
    2. Service Provider - Immo Lab sp. z o.o., ul. Mińska 29a, 03-808 Warsaw, NIP: 113-304-98-91,
    3. Website - the website at https://immolab.re/ and all its subpages,
    4. User - a natural person (with full legal capacity), a legal entity, or an organizational unit without legal personality using the Platform. The User may be either a natural person not conducting business activity or an entrepreneur,
    5. Consumer - according to the Civil Code of April 23, 1964 - a User who, as a natural person, performs a legal act via the Platform that is not directly related to their business or professional activity,
    6. Terms and Conditions - this document together with the Privacy Policy, which is an integral part of the Terms and Conditions. All documents are available on the Website.
  5. Users can contact the Service Provider electronically at ip@immolab.re.


§2 [SERVICES PROVIDED THROUGH THE PLATFORM]

 

  1. The Service Provider provides electronic services to Users through the Platform.
  2. The Service Provider does not charge fees for providing Services to Users.
  3. The essence of the Services is to provide access to the Platform via the Internet. Through the Platform, the Service Provider offers services such as a Contact Form.

 

§3 [GENERAL RULES FOR USING THE PLATFORM]

 

  1. To use the Services available through the Website or mobile devices, the User must meet the following technical requirements:
    1. have a computer, laptop, mobile phone, or other device with Internet access,
    2. have access to email,
    3. use an Internet browser (it is recommended to use the latest version),
    4. enable cookies in the browser,
    5. enable JavaScript support
  2. All actions taken by Users should comply with applicable laws and good practices.
  3. Any use of the Platform to harm other Users, the Service Provider, or third parties is prohibited.
  4. Each User agrees to:
    1. use the functionalities and resources of the Platform in accordance with its purpose,
    2. comply with Polish law,
    3. respect the rights and personal goods of other Users,
    4. not act to the detriment of other Users, the Service Provider, and third parties


§4 [RESPONSIBILITY. ACCESS AND USE OF THE PLATFORM]

 

  1. The Service Provider undertakes to take all actions to ensure proper, secure, continuous, and error-free access to the Platform.
  2. The Service Provider has the right to make changes to the Service and Platform in connection with ongoing work on improving and modernizing the Platform. In particular, the Service Provider has the right to change the functionalities of the Platform.


§5 [COMPLAINTS RELATED TO THE TECHNICAL FUNCTIONING OF THE PLATFORM]

 

  1. Each User is entitled to file a complaint regarding any irregularities in the operation of the Platform within 14 days of the occurrence of the irregularity. Complaints should be submitted via email to: ip@immolab.re. The description of the irregularity should allow the Service Provider to identify and resolve the problem.
  2. The Service Provider will review the complaint within 14 calendar days from the date of receipt.
  3. In the event of a serious technical error, the Service Provider reserves the right to limit access to the Platform service.
  4. All errors in the functioning of the Platform, comments, and information about the operation of the Platform and the Website, as well as violations of the Terms and Conditions, should be reported to the Service Provider electronically.

 

§6 [INTELLECTUAL PROPERTY RIGHTS]

 

  1. All materials, including graphic elements, the arrangement and composition of these elements, trademarks, and other information available on the Platform and Website, are the exclusive property of the Service Provider. These elements are subject to copyright protection, industrial property rights, including trademark registration rights, and database rights, and as such, they enjoy legal protection.
  2. Downloading or using any materials available on the Platform requires prior written consent from the Service Provider and must not violate these Terms and Conditions or generally applicable laws, nor may it infringe the interests of the Service Provider.
  3. Modifying and copying elements of the Website and Platform is prohibited.
  4. Creating websites and applications similar to or identical to the Platform that mislead recipients into believing they originate from or are associated with the Service Provider constitutes an act of unfair competition under applicable law.

 

§7 [FINAL PROVISIONS]

 

  1. In matters not regulated by these Terms and Conditions, the generally applicable Polish law shall apply.
  2. All disputes arising from these Terms and Conditions and the contract concluded between the User and the Service Provider shall be governed by Polish law and shall be subject to the jurisdiction of Polish courts. The competent court for disputes between the Service Provider and a User who is not a Consumer shall be the court competent for the Service Provider's registered office. The competent court for disputes involving a Consumer shall be the Consumer's place of residence.
  3. These Terms and Conditions are effective from February 10, 2025.
